Step 1: Making an Offer on a Property in Spain

Step 2: Reserving the Property

Once your offer is accepted, the property is temporarily reserved for you through an official document.

Key point:

  • Reservation Deposit

  • The amount will later be deducted from the final purchase price.

  • The property is taken off the market.

Sometimes this step is skipped, and we proceed directly to the preliminary sales contract (‘arras’), depending on the situation.

Step 3: Legal Check and NIE Number Application (if needed)

We strongly recommend hiring a specialized lawyer. They will check, among other things:

  • Property ownership rights and any outstanding debts

  • Building permits and land registry information

  • Whether everything complies with Spanish law

 A lawyer also assists you with:

  • Application for the NIE number (tax identification number for foreigners)

  • Opening a Spanish bank account

  • Arranging Power of Attorney and Notary Appointments in Spain

Step 4: Preliminary Sales Contract (‘arras’)

After the reservation, the next step is signing the preliminary sales contract.

This contract includes:

  • The agreements between buyer and seller

  • A deposit of 10% of the purchase price

  • The previously paid reservation amount is credited towards this deposit

  • The key handover date is scheduled

 

Step 5: Official Transfer of Ownership at the Spanish Notary Office

The official property transfer in Spain takes place at the notary. You can be present in person, or your solicitor can represent you with a power of attorney.

During this step:

  • At this stage, the final payment of the purchase price is made to complete the property transfer.

  • All applicable fees and property taxes are settled at this stage.

  • The property is registered in the Spanish Land Registry (Registro de la Propiedad).
